General Terms and Conditions (GTC)

1. Scope

1.1 These General Terms and Conditions (hereinafter "GTC") apply to the use of the mobile application "Evidence Base" (hereinafter "app") and to the conclusion and use of premium subscriptions.

1.3 By registering or using the app, the user accepts these GTC.

2. Description of services

2.1 The app provides access to scientific information, study summaries and community features in the area of dietary supplements, lifestyle and health-related topics.

2.2 Certain functions (in particular early access to studies, offline mode, PDF export and unlimited library) are available exclusively to premium users.

2.3 The provider endeavours to make the app available as uninterrupted as possible, but does not guarantee absolute availability.

3. Registration and user account

3.1 Using certain functions requires creating a user account.

3.2 The user is obliged to provide truthful information when registering and to keep their access data confidential.

3.3 The app is aimed at persons aged 16 and over. Persons under 16 may not use the app.

4. Premium subscriptions

4.1 The provider offers paid premium subscriptions (monthly and/or annually). Current prices are shown in the app or in the respective app store.

4.2 The contract for a premium subscription is concluded by purchasing via the Apple App Store or the Google Play Store. The respective conditions of Apple or Google apply in addition.

4.3 The subscription is automatically renewed for the respective term unless it is cancelled in good time via the settings of the respective app store.

4.4 Cancellation is possible at any time at the end of the current billing period. Cancellation is carried out via the account settings of the respective app store.

Right of withdrawal

Consumers have a statutory right of withdrawal. Details can be found in the withdrawal instructions.

If the user requests that Premium begin immediately, the right of withdrawal remains for 14 days. In the event of withdrawal, the full amount is refunded without deduction for the days already used.

5. User content (Community)

5.1 Users can create and share their own content (in particular stacks, experiences and comments).

5.2 The user retains the rights to their own content. By uploading, the user grants the provider a simple, worldwide, non-exclusive and free right of use to display and technically provide the content in the app.

5.3 The user ensures that their content does not infringe the rights of third parties and does not violate applicable law.

5.4 The provider reserves the right to remove content and to block or delete user accounts if these GTC or the Community Guidelines are violated.

6. Health-related content

6.1 The information provided in the app is for general information only and does not replace medical advice, diagnosis or treatment.

6.2 Use of the content is at the user's own responsibility. For health-related questions, a doctor or alternative practitioner must always be consulted.

7. Liability

7.1 The provider is liable without limitation in the case of intent and gross negligence as well as for injury to life, body or health.

7.2 In the case of slight negligence, the provider is only liable for breach of essential contractual obligations (cardinal obligations) and limited to the foreseeable, contract-typical damage.

7.3 Liability for the correctness, completeness and up-to-dateness of the study summaries and other content provided in the app is excluded insofar as legally permissible.

8. Term and termination of the user account

8.1 The user account can be deleted by the user at any time.

8.2 The provider may block or delete the user account if the user violates these GTC or if there is another important reason.

9. Changes to the GTC

The provider reserves the right to adapt these GTC. The respectively current version is available in the app. Material changes will be communicated to the user in an appropriate manner.

10. Final provisions

10.1 The law of the Federal Republic of Germany applies to the exclusion of the UN Convention on Contracts for the International Sale of Goods.

10.2 Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions remains unaffected.

10.3 The place of jurisdiction is, insofar as legally permissible, Berlin.
